These Terms of Service (“Terms”) govern your access to and use of our websites and services (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Overview & Acceptance

Teacher’s Pet AI provides AI-assisted tools for educators, tutors, and homeschooling parents. Our Services are intended for adults.

By accessing or using the Services, you accept these Terms and our Privacy Policy.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization and that “you” refers to both you and the organization.

2) Accounts & Eligibility

You must provide accurate registration information and keep your credentials secure.
The Services are not directed to children; do not create accounts for or on behalf of a child.
If you input information about students or other individuals, you confirm you have all necessary permissions or consent to do so.

3) Acceptable Use

Do not misuse the Services. For example, you agree not to:

Break the law; infringe intellectual property or privacy rights; or submit unlawful content.
Attempt to access non-public areas, interfere with system integrity, or circumvent technical limits.
Reverse engineer, scrape, or bulk-extract content except as allowed by applicable law.
Upload malicious code or content that is harmful, deceptive, or exploitative.
Collect children’s personal information without proper authorization/consent.

4) Your Content & Outputs

Your Content: You retain ownership of the content you submit.
Outputs (“Artifacts”): Results generated for you are stored in your account unless you delete them. You are responsible for reviewing outputs for accuracy and suitability.
No generalized model training: We do not use your content to train generalized models for other customers.

5) License & Ownership

Your license to us: A worldwide, non-exclusive, royalty-free license to host, process, and display Your Content to provide and maintain the Services, and to create de-identified/aggregated data for reliability and safety.
Our license to you: Limited, non-exclusive, non-transferable license to access and use the Services and outputs for your teaching purposes, subject to these Terms.
Feedback: Perpetual, irrevocable, royalty-free license to use feedback or suggestions without obligation.
Reservation of rights: Except for the limited rights above, we and our licensors retain all rights to the Services.

6) Plans, Billing & Taxes

Subscriptions: Paid plans auto-renew unless canceled. Access continues through the end of the current paid period.
Fees & Changes: Prices or features may change with notice for future cycles.
Refunds: Fees are non-refundable except where required by law.
Taxes: Prices may exclude taxes; you’re responsible for applicable taxes.

7) Termination

You may stop using the Services at any time and/or cancel a paid plan from your account settings.
We may suspend or terminate access if you breach these Terms, pose a risk, or as required by law.
Upon termination, your right to use the Services ends, but certain provisions survive (e.g., ownership, disclaimers, limitations of liability, indemnity).

8) Changes to the Services & Terms

We may modify or discontinue features and may update these Terms. If changes are material, we’ll provide notice (for example, in-app or by email). Continued use after changes means you accept the updated Terms.

9) Disclaimers, Limitation of Liability & Indemnity

THE SERVICES AND OUTPUTS ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED CONTENT MAY BE INACCURATE OR INCOMPLETE; YOU ARE RESPONSIBLE FOR REVIEWING AND VERIFYING OUTPUTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TEACHER’S PET AI NOR ITS AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Indemnity

You will defend, indemnify, and hold harmless Teacher’s Pet AI from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, Your Content, or violation of these Terms.

10) Miscellaneous

Governing Law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts of law.
Venue: Courts located in Delaware will have exclusive jurisdiction, except where prohibited by law.
Severability: If any provision is unenforceable, the rest remain in effect.
Assignment: You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, or sale.
Entire Agreement: These Terms and any referenced policies (like our Privacy Policy) are the entire agreement between you and us.
